Terms & Conditions — Hoiii Walk

1. Acceptance of Terms

These Terms form a legally binding agreement between you and Kacci Lab Inc. for your use of Hoiii Walk. By creating an account or using the Services, you acknowledge that you have read and accepted these Terms and our Privacy Policy.

Connection to TripPlanGo: Hoiii Walk is the standalone FunWalking experience from TripPlanGo. If you sign in with the same account, coins, rewards eligibility, and related progress may sync across apps.

2. Eligibility

• You must be at least 13 (or the higher age required in your jurisdiction) to use the Services.
• You represent you have legal capacity to enter these Terms.

3. Accounts & Security

• Provide accurate information and keep it current.
• Keep your credentials secure and notify us of suspected unauthorized access.

4. The Services & Your Responsibilities

Hoiii Walk is a walking and collection game that can convert your steps into in-app coins and allow redemptions for rewards. You are responsible for maintaining compatible devices, enabling required permissions, and ensuring your account information is accurate.

Not medical: Hoiii Walk is not a medical device, medical service, or emergency service. Step/activity counts may be inaccurate due to device limitations.

5. Coins, Gameplay & Rewards

Coins

• Coins are a virtual in-app unit used for gameplay and rewards. Coins are not legal tender, not stored value, not a bank account, and have no cash value unless we explicitly state otherwise in writing.
• Coin earning rates, eligible activities, and redemption requirements may change for gameplay balance, fraud prevention, operational needs, or legal compliance.

Rewards (merchandise & digital gift cards)

• Discretion & availability: Reward catalogs, denominations, and eligibility vary by country/region and are offered at our discretion, subject to availability, legal restrictions, and partner constraints. We may change, substitute, pause, or discontinue rewards at any time.
• Region gating: Certain rewards (especially digital gift cards) may be unavailable in your country. If a reward is not available, you may be shown alternatives or no option at all.
• Fulfillment partners: We may use third-party fulfillment partners and carriers to deliver merchandise or gift cards.
• Shipping details: For physical merchandise, you must provide accurate shipping details. If an address is incomplete/incorrect, delivery may fail or be delayed. We are not responsible for losses caused by incorrect address details provided by you.
• Duties/taxes: Depending on your location, you may be responsible for customs duties, import taxes, or other fees charged by your jurisdiction or carrier.
• No resale: Rewards may not be resold, exchanged, or transferred where prohibited by law or partner rules.
• Fraud/abuse: We may reject, delay, cancel, reverse redemptions and/or suspend accounts if we reasonably suspect abuse, automation, manipulation, policy violations, or legal non-compliance.

We do not promise that any specific reward will be available at any time or in any country. Screenshots, marketing text, and examples are illustrative only.

6. Device Permissions, Location & Steps

• Some features require device permissions (e.g., fitness/steps, location, notifications). You can disable permissions in device settings; related features may not function.
• Location signals may be used for map-based features (e.g., item placement, egg fragments, relic potions). Location accuracy depends on your device and environment.
• Step counts are obtained from permitted device fitness APIs; device sensors may be inaccurate or behave differently across devices/OS versions.

7. Acceptable Use

You agree not to:

• Use the Services for unlawful, harmful, deceptive, or fraudulent purposes.
• Attempt to manipulate step counts, location signals, rewards, referrals, devices, emulators, scripts, or redemption workflows.
• Reverse engineer, scrape, or interfere with the Services or attempt unauthorized access.
• Impersonate others or misrepresent your affiliation.

8. Third-Party Services

The Services may integrate third-party services (e.g., fitness APIs, mapping providers, analytics, app stores). Their terms and privacy notices govern their services, and availability may change without notice.

9. App Stores, Subscriptions & Payments

• Purchases are processed by the Apple App Store or Google Play. Their terms and refund policies apply.
• Taxes may apply based on your location. We may change pricing or features upon notice permitted by the store(s) and applicable law.
• Trials auto-convert to paid unless cancelled in store account settings before renewal.

10. Intellectual Property; Feedback

• We (and our licensors) own the Services, including software, design, and content (excluding User Content, if any). We grant you a limited, non-exclusive, non-transferable license to use the Services for personal use in accordance with these Terms.
• Hoiii and branding: “Hoiii”, “Hoiii Walk”, logos, and related marks are trademarks or trade dress of Kacci Lab Inc. You may not use them without our permission.
• If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without restriction.

11. Availability; Beta Features; Changes

• The Services may change or be discontinued in whole or in part. We may introduce beta or experimental features that may be unstable or change at any time.
• We strive for high availability but do not guarantee uninterrupted service.
• We may modify coin earning rates, reward catalogs, eligibility rules, and redemption workflows to maintain integrity, comply with law, or improve the experience.

12. Disclaimers

• As-Is: The Services are provided “as is” and “as available,” without warranties of any kind.
• Rewards: We do not warrant that any reward will be available, error-free, or deliverable to all locations. Fulfillment timelines are estimates only.
• Fitness data: Step/activity data may be inaccurate; use your judgment.
• No emergency / medical advice: The Services do not provide emergency or medical services.

13. Limitation of Liability

To the maximum extent permitted by law, Kacci Lab and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the Services or these Terms. Our aggregate liability for all claims will not exceed the greater of USD $50 or the amounts you paid (if any) for the Services in the twelve (12) months preceding the event giving rise to liability. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

Without limiting the above, we are not liable for: (a) third-party reward partner failures; (b) carrier delays; (c) losses caused by incorrect shipping details you provide; or (d) device sensor inaccuracies affecting step counts or map-based features.

14. Indemnification

You agree to defend, indemnify, and hold harmless Kacci Lab and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; or (c) your violation of law or third-party rights.

15. Term; Suspension & Termination

• These Terms remain in effect until terminated. We may suspend or terminate access (in whole or in part) if you violate these Terms, pose a security risk, abuse rewards systems, or if we discontinue the Services.
• Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive will survive.
• We may limit or disable redemption features for compliance, fraud prevention, or operational reasons.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.

You and Kacci Lab Inc. submit to the exclusive jurisdiction of the courts located in Toronto, Ontario, Canada, except that either party may bring an individual claim in small claims court where permitted.

Nothing limits mandatory consumer protections available to you under applicable law.

17. Export; Force Majeure; Miscellaneous

• Export: You must comply with applicable export control and sanctions laws.
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
• Entire Agreement: These Terms and the Privacy Policy are the entire agreement regarding the Services.
• Severability: If any provision is unenforceable, the remainder remains in effect.
• Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger, acquisition, or asset sale.
• No Waiver: Our failure to enforce a provision is not a waiver.
• Headings: Headings are for convenience only.
• Language: The parties have expressly requested that these Terms and all related documents be drawn up in English.

18. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will provide notice (e.g., in-app or by email). Your continued use after changes become effective constitutes acceptance.

Appendix: Apple App Store Terms

• You acknowledge these Terms are between you and Kacci Lab, not Apple. Kacci Lab is solely responsible for the App and its content.
• Your use of the iOS App must comply with the App Store Terms of Service.
• Apple has no obligation to furnish maintenance or support; Kacci Lab is responsible for support.
• In the event of any failure of the iOS App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the iOS App; to the maximum extent permitted by law, Apple has no other warranty obligation.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS App, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Appendix: Google Play Store Terms

• Relationship with Google. These Terms are between you and Kacci Lab Inc., not Google. Your use of the Android App is also subject to the Google Play Terms of Service and any applicable policies.
• Support & Maintenance. Google has no obligation to provide maintenance or support for the App. Kacci Lab Inc. is responsible for App support.
• Refunds & Billing. Purchases and subscriptions made through Google Play are processed by Google. Refunds, cancellations, and renewals are handled under Google Play policies and your Play account settings, where applicable.
• Compliance & Export. You represent that you comply with applicable laws, including export control and sanctions laws, and that you are not located in an embargoed country or on a prohibited party list.
